Drave Media provides a range of digital marketing and e-commerce services, including but not limited to media buying, performance marketing, SEO, conversion rate optimization, creative design and development, public relations, social media marketing, e-commerce solutions and more. These services are governed by the following Terms and our Service Agreement, where applicable.

Eligibility
To use our services, you must be at least 18 years old and have the legal capacity to enter into binding contracts. By using our services, you represent and warrant that you meet these requirements.

Client Onboarding
We do not use client accounts on our website. Communication and onboarding are managed through our "Contact Us" form and direct email or phone correspondence. All service terms and arrangements are formalized through personalized Service Agreements.

Scope of Services
Our services are provided as outlined in your Service Agreement or contract with Drave Media. While we strive to deliver high-quality services, you acknowledge that results may vary, and we do not guarantee specific outcomes, such as a specific ROI or customer conversion rate.

Payment Terms

  • Late Payments: Late payments may be subject to penalties, as specified in the Service Agreement.

  • Billing and Invoices: Our fees are outlined in the Service Agreement. You agree to pay all charges on time and in accordance with the terms specified.

  • Refunds: Refunds are available only as stipulated in your Service Agreement. Otherwise, all payments made are final and non-refundable unless otherwise agreed in writing.

Intellectual Property

  • Ownership: All intellectual property created by Drave Media as part of our services, including but not limited to advertising campaigns, creatives, and marketing strategies, remains the property of Drave Media unless otherwise agreed in writing.

  • License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive license to use deliverables created for you under the Service Agreement. You may not modify, distribute, or create derivative works without our written consent.

  • Client Materials: You grant us a non-exclusive, royalty-free license to use any materials you provide (such as logos, brand assets, and content) solely to perform our services.

Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of the service relationship. Neither party will disclose this information to third parties without the other party’s written consent, except as required by law.

Prohibited Activities

  • Use our services for any unlawful or fraudulent activity.

  • Engage in any conduct that disrupts or negatively impacts the services provided by Drave Media or other clients.

  • Attempt to reverse engineer or copy our proprietary systems or methods.

  • Violate any applicable laws or regulations related to digital marketing, advertising, or e-commerce.

Limitation of Liability
To the fullest extent permitted by law, Drave Media shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of our services. Our liability for direct damages shall be limited to the total amount paid by you for the specific service giving rise to the claim, as outlined in your Service Agreement.

Disclaimers
Our services are provided on an "as-is" and "as-available" basis. We make no warranties or representations, express or implied, about the accuracy, reliability, or suitability of our services for any particular purpose. You assume full responsibility for your use of our services and for evaluating any risks involved.

Indemnification
You agree to indemnify, defend, and hold Drave Media and its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, or expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of our services in a manner inconsistent with our Terms or Service Agreement.

  • Your breach of these Terms or any applicable laws.

  • Any content or materials you provide to us in connection with our services.

Termination

  • Termination by Client: You may terminate your relationship with us by providing written notice as specified in your Service Agreement.

  • Termination by Drave Media: We reserve the right to terminate or suspend our services at our discretion if you violate these Terms, fail to make payments, or engage in activities that may harm Drave Media’s reputation or business operations.


Upon termination, all outstanding payments will become immediately due, and any licenses granted to you will be revoked.

Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Pakistan, the United Kingdom, and the United States, depending on the office providing the services. Any disputes arising from these Terms will be subject to the jurisdiction of courts in the respective countries where services are provided.

Modifications to Terms
We reserve the right to update these Terms at any time to reflect changes in our business practices, legal requirements, or service offerings. Any updates will be posted on our website, and your continued use of our services after changes have been made constitutes your acceptance of the revised Terms.
